Terms of Service

1. Agreement

By creating a Yummm account or using the Yummm platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to venue operators (businesses using Yummm) and form a binding agreement under Australian law.

2. The Service

Yummm provides venue operators with tools including:

  • A branded venue website with custom domain support.
  • Online menu display and management.
  • Takeaway and pickup ordering.
  • Table booking and reservation management.
  • Customer database and marketing automation.

3. Accounts & Access

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at hello@yummm.com.au if you suspect unauthorised access. Yummm is not liable for losses caused by unauthorised account access.

4. Subscription & Billing

  • Plans are billed monthly or annually as selected at signup.
  • All prices are in Australian Dollars (AUD) and include GST where applicable.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds are not provided for partial billing periods unless required by Australian Consumer Law.
  • We reserve the right to change pricing with 30 days’ written notice.

5. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. There are no lock-in contracts. Your data will be available for export for 30 days after cancellation before deletion.

6. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes or in violation of Australian law.
  • Misrepresent your business, menus, or pricing to customers.
  • Attempt to reverse engineer, copy, or resell the Yummm platform.
  • Use the Service in a way that harms other users or Yummm’s infrastructure.
  • Upload content that is defamatory, offensive, or violates third-party rights.

7. Your Content

You retain ownership of all content you upload (menu items, images, business information). By uploading content, you grant Yummm a licence to display that content to your customers through the Service. You are responsible for ensuring your content does not infringe third-party intellectual property rights.

8. Customer Data

Customer data collected through your Yummm website (orders, bookings, contact details) belongs to you, the venue operator. You are responsible for using that data in compliance with the Australian Privacy Act 1988 and any other applicable laws. Yummm processes this data on your behalf as a data processor.

9. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, Yummm’s liability for any claim is limited to the fees paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential losses including lost revenue or data. Nothing in these Terms excludes rights granted under the Australian Consumer Law that cannot be excluded.

10. Uptime & Support

We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. Support is provided via email during Australian business hours.

11. Termination

We may suspend or terminate accounts that violate these Terms, with notice where practical. You may terminate at any time as per Section 5. On termination, access to the Service ends and data will be deleted per our data retention policy.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria. Nothing in these Terms limits rights under the Australian Consumer Law.
